6. Ownership, Data Rights & Monetization

Absolute Ownership

All Data on the Platform, including user-submitted data, system-generated outputs, analytics, and derivative works, shall be the exclusive property of OSWAR TECK SYSTEMS PVT. LTD.

License from Users

Users grant the Company a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use, reproduce, modify, analyse, distribute, and commercially exploit all the data.

Commercial Exploitation & Sale of Data

You expressly agree that the Company may:

• Store, process, monetize, license, sell, or transfer Data to third parties
• Use data for AI/ML training
• Use data for market analytics and reports
• Use data for commercial partnerships and product development
• Create derivative datasets and combine your data with third-party data

Anonymization

The Company may convert data into anonymized or aggregated form and freely sell or use such anonymized data without restriction.

Personal Data Compliance

Personally identifiable data shall be processed in accordance with Digital Personal Data Protection Act, 2023 and Information Technology Act, 2000. Where required, consent shall be obtained.

No Compensation

Users shall not receive payment, royalties or revenue share for any use or sale of data.

Survival

These rights survive termination of your account.

No Professional Advice

All content, including vehicle valuations, analytics, recommendations, and insights:

• Are informational in nature only
• Do not constitute professional, financial, legal, or technical advice

Users are advised to independently verify information before relying upon it.

AI & Valuation Disclaimer

The Platform may use automated systems, algorithms, or AI tools to generate vehicle valuations, insights and analytics. The Company does not guarantee accuracy, and such outputs:

• May vary based on input data
• Should not be relied upon as definitive or binding

Third-Party Content

The Platform may include user-generated or third-party content. The Company does not endorse such content and is not responsible for its accuracy or legality.

User Responsibility

Users acknowledge that:

• Use of the Platform is at their sole risk
• They are responsible for verifying any data or output

13. Refund & Cancellation Policy

General Policy

All payments made to the Company for services, subscriptions, or features on AUTIX are non-refundable, except as expressly provided herein.

Subscription Services

Subscription fees are billed in advance. Once charged, such fees are non-refundable and non-transferable. Cancellation will take effect at the end of the billing cycle.

Exceptional Refunds

Refunds may be granted solely at the discretion of the Company in cases such as:

• Duplicate transactions
• Technical errors attributable to the Platform
• Failure to provide the purchased service

No Refund Scenarios

No refunds shall be provided for:

• Change of mind
• Lack of usage
• Dissatisfaction with AI-generated outputs or valuations
• User error or incorrect inputs

Processing Time

Approved refunds, if any, shall be processed within 7–15 business days to the original mode of payment.

Chargebacks

Users agree not to initiate chargebacks without first contacting the Company. Unauthorized chargebacks may result in suspension of account or legal action.

14. User Content Policy

Definition of User Content

“User Content” includes all data uploaded, posted, shared, or transmitted by Users, including images, videos, documents, comments, reviews, and descriptions.

Ownership & Rights

Users may retain nominal ownership of their content. However, all such content is subject to the broad license and ownership provisions granted to the Company under the terms.

Prohibited Content

Users shall not upload or share content that:

• Is false, misleading, or fraudulent
• Violates any law, including the Information Technology Act, 2000
• Infringes intellectual property rights
• Is defamatory, obscene, abusive, or harmful
• Contains viruses or malicious code

Content Moderation

The Company reserves the right to:

• Review, monitor, and remove any content
• Suspend or terminate accounts for violations
• Take legal action where necessary

No Obligation to Publish

The Company is under no obligation to host, display, or maintain any user content or provide reasons for removal of such content.

User Responsibility

Users are solely responsible for:

• Obtaining necessary rights/permissions
• Consequences arising from publication

Takedown & Complaints

If any person believes content violates their rights, they may contact us at legal@autix.in. Upon receiving a valid complaint, the Company may remove or restrict access to the content and take appropriate action.

Data Use of Content

User Content may be:

• Stored, analyzed, and processed
• Used for AI training and analytics
• Commercially exploited, including sale, as per the Terms

15. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India. Courts having jurisdiction over the Company's registered office shall have exclusive jurisdiction.

16. Changes to Terms

We reserve the right to modify this Agreement at any time. Continued use constitutes acceptance.
